WEBSITE USER AGREEMENT

This website is owned and operated by LA CEYLON TOURS (PRIVATE) LIMITED, a company duly incorporated under the company laws of Sri Lanka, having its registered office at  No. 250, Orex City Ekala , Srilanka, in the Democratic Socialist Republic of Sri Lanka (hereinafter, as and when the context so requires, called and referred to as “La Ceylon Tours”).

By accessing and using this website, you agree to be bound by the terms and conditions of use, set out hereinbelow. The attached terms of online reservations (hotel bookings, transport, vehicle hire, transfers & excursions) will apply when you make your reservations online and shall form part and parcel of this agreement. The principals of data protection of LaCeylon Tours are also annexed hereto for your reference.

TERMS AND CONDITIONS OF USE

1. ACCEPTABLE USE

You (customer / agent) may use this website in accordance with these terms and conditions for lawful and proper purposes complying with all applicable laws, regulations and codes of practice in Sri Lanka or other jurisdictions from which you are accessing the website.

In particular, you (customer / agent) agree you (customer / agent) shall not post, transmit or disseminate any information via this website which is or may be harmful, obscene or otherwise illegal.

You (customer / agent) also agree not to:

Use this website in a manner which causes or may cause an infringement of the rights of another.

Use any software, routine, procedure or device to interfere or attempt to interfere with the operation or functionality of this website including but not limited to making available corrupt data, viruses via whatever means or interfere with its availability to others.

Deface, alter or interfere with the look and feel of this website or underlying software code.

Take any action that imposes an unreasonable or disproportionately large load on the website or related infrastructure.

Obtain or attempt to obtain unauthorised access by whatsoever means to any of our networks.

Where LaCeylon Tours believe in its absolute discretion that you (customer / agent) are in breach of any of these terms and conditions, without prejudice to any of our rights at law or otherwise, we reserve the right to deny you (customer / agent) access to this website.

2. COPYRIGHT AND RESTRICTIONS ON USE

All trademarks, service marks, copyright, database rights, and other intellectual property rights in materials on this website, as well as the organisation and layout of this website together with the underlying software, belong to LaCeylon Tours or its licensors.

The trademark, service mark and logos of LaCeylon Tours and its licensors must not be used, modified or adapted in any way without the prior written authorisation of LaCeylon Tours.

The material on this website and the underlying software codes may not be copied, modified, altered, published, broadcast, distributed, linked to another website, sold or transferred whole or in part without an express written permission of LaCeylon Tours. However, the information contained here may be downloaded, printed or copied for your personal non-commercial use.

3. DISCLAIMER, LIMITATION OF LIABILITY AND INDEMNITY

This website has been compiled in good faith by La Ceylon Tours. No representation is made, or warranty given, either express or implied as to the completeness or accuracy of the information that it contains, that it will be uninterrupted or error free or that any information is free of bugs, viruses, worms, Trojan horses or other harmful components.

To the maximum extent permitted by law, La Ceylon Tours disclaims all implied warranties with regard to information, products, services and material provided through this website. All such information, products, services and materials are provided “as is” and “as available” without warranty of any kind.

This website may contain links to a website operated by third parties. Such links are provided for your reference only and your use of these sites may be subject to terms and conditions posted on them. LaCeylon Tours inclusion of links to other websites does not imply any endorsement of the material on such websites and La Ceylon Tours accepts no liability for their contents.

By accessing this website you agree that La Ceylon Tours shall not be liable for any direct, indirect or consequential loss or damages of any nature arising from the use of this website; this includes information and material contained in it, from your access of other material on the internet via web links from this website, delay or inability to use this website or the availability and utility of the products and services.

You further agree to indemnify, hold La Ceylon Tours harmless from and covenant not to sue LaCeylon Tours for any claims, damages / loses based on using this website.

4. MODIFICATION OF TERMS

La Ceylon Tours may make improvements and / or changes in the products, services and prices described in this website at any time without prior notice. Changes are periodically made to the website. La Ceylon Tours may amend these terms by posting the amended terms on this website. Continued use of this website following such changes shall constitute your (customer / agent) acceptance of such changes.

5. AGE AND RESPONSIBILITY

You (customer / agent) represent that you (customer / agent) are of sufficient legal age to use this website; additionally, you (customer / agent) possess the legal right and ability to enter into this agreement and use this site in accordance with all of the applicable terms and conditions and create binding legal obligations for any liability you may incur as a result of the use of this website under your (customer / agent) name or account including, without limitation, all use of your (customer / agent) account by others including minors living with you (customer / agent).

6. PRIVACY POLICY

LaCeylon Tours is using a secured website for the transaction of personal data communicated. We do not capture personal information without your (customer) knowledge or your (customer) permission. You (customer) will only be asked to provide personal information when you are taking advantage of this site’s interactive products and services.

7. FEEDBACK

LaCeylon Tours is free to use, reproduce, disclose and or distribute the information, ideas, know-how in your (customer / agent) feedback to others without limitation and for any purpose whatsoever.

8. OTHER TERMS

This agreement constitutes the entire terms governing your access to dealings with and use of this website. Separate arrangements may attach to products or services you obtain, purchase or use from the site. You can find details of these terms under those particular products or services, or from the service providers.

9. GOVERNING LAW

The laws of the Democratic Socialist Republic of Sri Lanka govern the use of this website and you irrevocably submit to the non-exclusive jurisdiction of the courts of Sri Lanka. LaCeylon Tours reserves the right to bring proceedings against you in the country of your residence.

THE PRINCIPLES OF DATA PROTECTION

La Ceylon Tours takes the protection of customer privacy and customer personal data very seriously. We would, therefore, like to explain what data we collect, what we use it for and how we protect customer data. These data protection principles do not apply to websites that may be accessed by clicking on hyperlinks on main web pages.

1. General information on data protection and the purpose of data storage

What data do we collect?

Reserving

Whenever you (customer) make a tour reservation using the LaCeylon Tours website, we collect the data that we require to make the reservation, particularly your (customer) name, telephone number and email address (“contact details”), as well as your (customer) arrival and departure dates, the name of the hotel and the type of room reserved (“reservation details”).

Contact

General questions may be addressed to us using the “Contact” field. In order to be able to process your (customer) enquiries, we collect your (customer) contact details. This data is deleted again once the enquiry has been dealt with.

Who gets my data?

Whenever you (customer) make a reservation using the LaCeylon Tours website, your (customer) reservation details are passed onto your (customer) chosen hotel to enable the reservation to be made. Apart from this, your (customer) data is not passed on to any third parties. Under no circumstances will the La Ceylon Tours website sell or lend out your (customer) contact details. In exceptional circumstances, legal regulations, judicial or official orders may require us to hand data over to the relevant authority or court. However, this is only undertaken within the framework of our legal obligations.

2. Information on data protection

How safe is it to transfer data to LaCeylon Tours website?

All data you (customer) provide to LaCeylon Tours website is encoded and transmitted using the SSL (Secure Sockets Layer) protocol. This is a tried-and-tested system used by browsers the world over to encrypt data automatically before transmitting it to the intended recipient.

How secure is my data on the LaCeylon Tours website database?

We apply the LaCeylon Tours website’s strict safety standards for our database and internet server in order to provide effective protection against loss, misuse, divulgence, alteration and deletion of and unauthorised access to your (customer) data.

3. Cookies

What are cookies?

Cookies are small pieces of information that your browser stores on your computer’s hard disk. They simplify reservation by automatically calling up frequently used data on sites you have already visited. You can set your computer to not store any cookies on your computer. However, this may prevent you from using some of the functions we offer.

QUESTIONS

You may ask to see your stored personal data at any time. You also have the right to correct, delete or (in the case of incorrect data) bar such data. Contact details should be amended under the LaCeylon Tours website. However, contractual and / or legal regulations, particularly those relating to accounting and payment, may prevent certain data from being deleted.

ONLINE RESERVATIONS

GENERAL TERMS AND CONDITIONS

The above rates are net and include all government taxes totaling to 13%.

These rates are subject to current government taxes. If any taxes are revised including VAT, the rates quoted will be revised accordingly.

Discount for children from 02 to 12 years sharing the parents’ room: 30% per-person sharing double room rate.

Discount for the third person sharing a triple room: 10% per person sharing double room rate.

** Please note that the extra bed in a triple room will be a foldable and rollaway bed.

THE ABOVE PRICE INCLUDES:

• Accommodation is as described on your tour proposal and listed dates along with the written meal plan in line for each day as agreed by you upon confirming the standard of room types and hotel standards as proposed on the tour proposal
• Transportation by air-conditioned vehicle from Colombo to Colombo, as per the sent itinerary
• Acting for an on behalf of La Ceylon Tours shall facilitate for the purchase of tickets by way of to enter destinations in the Cultural Triangle and other important places. Guests of LaCeylon Tours  shall pay the appropriate sum of money for the purchase of tickets to LaCeylon Tours   shall act as the custodian of this money. For this service, LaCeylon Tours. shall charge a commission plus appropriate indirect taxes from the guests as shown and explained in the tour proposal.

ABOVE PRICES DO NOT INCLUDE:

• Video camera permits at Pinnawala Elephant Orphanage
• Video camera and still camera permits at the Temple of the Sacred Tooth Relic in Kandy
• Extra Foods throughout the tour
• Entrance fees to sites
• Christmas and New Year’s Eve supplements at hotels
• Supplement for accommodation in Kandy during the Kandy Esala Perahera period (July or August)
• Cost of a ticket to view the Kandy Esala Perahera which will be held in Kandy
• Cost of beverages throughout the tour
• Expenses of a personal nature
• Any other services not specified above

OTHER CONDITIONS

Optional excursions and additional services could be provided for which we will charge additionally.

Visits to wildlife parks will be at client’s own risk.

Safari vehicles (non air-conditioned) available are very basic with basic insurance cover (not comprehensive as in the case of vehicles used for tours).

CANCELLATION CHARGES

SPECIAL ROOM REQUESTS

Where special requests eg: room locations, interconnecting / adjacent rooms, double / twin beds, smoking / non-smoking rooms, etc. are an important factor in the choice of holiday, please advise us when the booking is made. We will pass on your request to the hotel but cannot guarantee that it will be accommodated.

ITENARY PLANING

Itinerary Changes by LaCeylon Tours –

All efforts will be made to provide your exact itinerary. LaCeylon Tours reserves the right, however, in unavoidable circumstances, to make adjustments. Exceptional circumstances such as an emergency change of accommodation while you are on holiday, we will refund you appropriately if the replacement hotel is cheaper.

Itinerary Changes Requested By You –

Best of Lanka’s aim is to offer flexible itineraries. Once an itinerary is finalized and paid, requests for changes will be considered, but cannot be guaranteed and may incur additional premium.

Cancellation By Us – We consider your holiday seriously. However, we reserve the right to cancel your holiday due of unforeseen circumstances. In this event we will refund all money paid by you and, wherever possible, offer an alternative holiday with comparable type and quality. We cannot be held liable for any expenses that may be incurred by you during arrangements for a holiday that is subsequently cancelled by us.

Suppliers and Service providers – LaCeylon Tours is not liable for any transaction you (Client) do with any other third party service provider during the tour other than LaCeylon Tours. LaCeylon Tours provides all mentioned services only through our contracted partners. If you deem to use any third party service provider during the tour, it is solely at your responsibility and LaCeylon Tours is not liable for any charges or fees incurring due to it.

Flight Times and Other Essentials – LaCeylon Tours not be responsible for flight delays and additional expenses resulted by flight delays. You must also ensure that your travel documents, passports, visas, driving license, insurance details and moneys are in order.

Force Majeure – We cannot accept responsibility for Force Majeure – defined in these booking conditions as any specific event, which we, as the supplier of the services, could not reasonably have foreseen, influenced or avoided. These include war, or threat of war, riots, civil strife, terrorism, contamination, extreme or unusual weather conditions, industrial disputes, changes to sports itineraries, natural and nuclear disasters, fire, flight cancellations or rescheduling by airlines or any similar event beyond our control.

Insurance – Every client of LaCeylon Tours , without exception, must possess valid travel insurance, and details of the policy must be stated before travel. Clients must ensure that this travel insurance offers acceptable cover for the type of holiday undertaken. We may refuse travel for all those insufficiently insured.

Health – All tourists are strongly advised to verify on recommended inoculations, the need for malaria tablets, and to take other medicinal advice where their own health record suggests it is necessary, at least a month before travel.

Nature of Overseas Travel – Holidays offered by LaCeylon Tours can range from lavish itineraries to budget-conscious. We will make every attempt to ensure that our planning is careful. But facilities and infrastructure in Sri Lanka can at times be comparatively underdeveloped. Delays, moments of uneasiness and risk can naturally occur in all travel. In the tropics, insects in rooms are common. Tourists booking any of our arrangements implicitly accept this as a fact of life.

Representatives – The full-time presence of LaCeylon Tours Tours representatives is not routine. This depends on your choice of holiday and/or the extent of the support you have requested. It is your responsibility to confirm that these arrangements are sufficient.

Information provided by us – LaCeylon Tours does not guarantee that all information available in our website is free from errors. But we will use all reasonable efforts to correct any errors once notified of them. Whilst we meticulously make every effort for accuracy, these opinions are necessarily subjective to some degree.

Complaints Procedure – Any complaints must be pursued as soon as possible with the supplier of the service (example – hotel manager), or the chauffeur. If matters are still not satisfactorily resolved, the complaint must be put in writing within 24 hours and you must notify to LaCeylon Tours immediately, by calling us on 94 77 3476288 or fax or e-mail, in a auxiliary effort to rectify the situation harmoniously. We reserve the right to refuse liability if this settlement procedure is not adhered to.

Hotel Reservation Conditions – LaCeylon Tours acts as a booking agent only in respect of all bookings LaCeylon Tours makes on your behalf. LaCeylon Tours undertakes no responsibility for, and are not liable for, the misrepresentations, breaches of contract, breaches of statutory duty or negligence of any of the accommodation providers and other suppliers of services who sell their products and services through us. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of an accommodation provider or other supplier of services (or their employees or agents) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and LaCeylon Tours will be under no liability at all (whether in contract, tort or otherwise howsoever). By proceeding to book accommodation and/or other services through the Site, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. If they are provided, LaCeylon Tours will Endeavour (but undertake no liability to do so) to make copies of the accommodation provider’s terms and conditions available to you. You understand that LaCeylon Tours may not have conducted any quality or other checks on the accommodation providers and LaCeylon Tours makes no representations about the suitability of the accommodation and/or services offered for sale through the Site. The inclusion or offering for sale of an accommodation and/or services by LaCeylon Tours does not constitute an express or implied endorsement or recommendation by LaCeylon Tours of such accommodation or services. LaCeylon Tours does not guarantee the accuracy of, and disclaim liability for any inaccuracies relating to, the accommodation and services offered for sale through us. services offered for sale through us. Nothing in these terms of use shall operate to exclude or limit the liability of LaCeylon Tours for fraudulent misrepresentation or death or personal injury caused by our negligence. Where you, or any of the people that you are booking on behalf of, are in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, LaCeylon Tours reserves the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behavior. We reserve the right to cancel your booking in case of non-payment or partial payment and will inform you of this.

IMPORTANT NOTE

There may be an unforeseen escalation in fuel prices, new taxes / levies on hotels and transportation services or hikes in entrance fees; any large tax hikes and new levies shall also be payable extra and shall be billed accordingly with reasonable prior notice.

If a customer makes a hotel reservation through LaCeylon Tours acting on behalf of the hotel and when the client cancels a reservation instead of contracting the hotel directly, he or she may contact La Ceylon Tours and receive a cancellation confirmation code. In this situation, the hotel cannot process “No – Show Transaction” when the client cancelled the reservation according to the La Ceylon Tours cancellation policy, and the client has the cancellation number. Failures in communication and La Ceylon Tours must be resolved by the two parties without involving the cardholder.

GENERAL REMINDER

• The program is based on the availability of the hotel rooms at the time of forwarding the quotation. As such, rooms are subject to availability at the time of booking.
• Due to high occupancy / demand, the hotels accept only the confirmed bookings.
• Once our proposal is accepted, the final confirmation will be forwarded along with the relevant overnight stays and itinerary. We will do our best to book the mentioned hotels or alternate similar category hotels.
• In case of any price fluctuations due to change of hotels, we will send a revised quotation.

HOTEL RULES AND REGULATIONS

• The official check-in time at all hotels will be 12:00pm to 02:00pm (depends on the hotel).
• The official check-out time at all hotels will be 11:00am.
• Hotel check-in / check-out times are fixed and there are no guarantees for early / late check-in / out unless paid for.

CURRENCY CONVERSION POLICY

This website accepts payments in

• Australian dollar (AUD)
• Canadian dollar (CAD)
• British pound sterling (GBP).

Please note that neither La Ceylon Tours (Pvt.) Ltd. nor the owning company it represents on this website will be liable for any exchange rate losses/gain due to any transactions/refunds processed, irrespective of the customer’s credit/debit card currency.

Before you travel

La Ceylon Tours is not liable for damages or losses that may result from travel to any particular destination. The Government of your country may help travelers stay safe overseas. Check with your government for the latest advice on conditions and general information concerning specific countries.

It is your responsibility to ensure you have the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, identification, and passport. La Ceylon Tours shall not be liable for any expense incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.

Site content, documentation and booking information

LaCeylon Tours may modify the content of the Site and/or Terms at any time, and such modification shall be effective immediately upon posting of the modified content and/or Terms on the Site and your continued use of or access to this website will be deemed to indicate your acceptance of the modified content and/or Terms.

Any information placed on the Site relating to hotels advertised on the Site including, but without limitation, details of the hotel, the availability of rooms at the hotel, the price of the rooms, the facilities available at the hotel, any accreditations afforded to the hotel and/or any details relating to any other services advertised on the Site have been placed on the Site by accommodation and/or service providers who are independent businesses and are not agents or employees of La Ceylon Tours or its affiliates. Such information does not constitute any advice or recommendation given by La Ceylon Tours and La Ceylon Tours shall not be held liable for inaccuracies or errors in the accommodation contents or any of its elements. These independent businesses provide the services in accordance with their own terms and conditions which may limit or exclude their liability to you. La Ceylon Tours and its affiliates are not liable for any acts, omissions, breaches, or negligence of any such independent businesses or any damages or expenses resulting from the aforesaid. La Ceylon Tours and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.

Confirmation

To confirm a booking, you must be authorized to make the booking by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.

Age and Responsibility

You warrant that you are 18 years of age or over and have the legal capacity to use the Site and to create a legally binding contract.

You hereby authorize La Ceylon Tours to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group.

Legislation and Courts of Jurisdiction

This agreement will be governed by the law of Peoples Democratic Socialist Republic of Sri Lanka and any disputes will be dealt with by the Sri Lanka Courts.

Site Use

La Ceylon Tours may suspend access to the website, due to maintenance works, net security reasons or force majeure with no obligation to reimburse or compensate you for the period in which access was suspended.

Access to the Site is strictly controlled by La Ceylon Tours and LaCeylon Tours reserves the right to change, modify, substitute or suspend, or remove without notice any information or service from time to time.

You may download one copy of the content of the Site for your own personal use but you may not in so doing remove any trademark, copyright, or other proprietary notice. You may not otherwise copy, modify, reproduce, sell, lease, market, or distribute the content placed on the Site without the prior written consent of LaCeylon Tours.

You may only use this website to make legitimate enquiries or bookings for yourself or another person for whom you are legally authorized to act.

You shall not:

Make any other unauthorized, false or fraudulent booking;

Use any software, routine or device to interfere or attempt to interfere electronically or manually with the operation or functionality of this website including, but not limited to, uploading or making available files containing corrupt data or viruses via whatever means;

Deface, alter or interfere with the appearance and layout of this website or the underlying software code;

Take any action that imposes an unreasonable or disproportionately large load on this website or related infrastructure;
